Welcome to Horlio! These Terms of Service ("Terms") govern your access to and use of the Horlio website, products, and services (collectively, the "Services"), provided by ever-growing GmbH. Please read these Terms carefully before using our Services.

1. Your Workspace and Use of Services

By creating a workspace, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

Eligibility: You must be at least 18 years old to use the Services.

To use our Services, you must create a workspace. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your workspace. You must notify us immediately of any unauthorized use of your workspace.

Compliance: You agree to use our Services only for lawful purposes and in accordance with these Terms. You are solely responsible for ensuring your use of the Services complies with all applicable laws, regulations, and third-party terms, including but not limited to LinkedIn's Professional Community Policies and User Agreement.

Prohibited Actions: You agree not to:

Engage in any conduct that is fraudulent, deceptive, or harmful.
Use the Services in a manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Services.

2. Subscription, Billing, and Cancellation

Certain Services are provided on a subscription basis. All fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law or as specified in your subscription plan. We reserve the right to change our subscription fees with 30 days' prior notice. Such notice may be provided at any time by posting the changes to the Horlio site or by email.

3. Our Intellectual Property vs. Your Data

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by ever-growing GmbH, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. Termination of Your Workspace

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will cease immediately. You can cancel your subscription at any time from your profile settings.

5. Disclaimers and Limitation of Liability (The "As Is" Clause)

While we implement robust security measures designed to protect your data and account as detailed in our Privacy Policy, the Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Ever-growing GmbH makes no warranties of any kind, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will always be uninterrupted or error-free.

To the fullest extent permitted by applicable law, in no event shall ever-growing GmbH, its affiliates, directors, or employees, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

6. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

7. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
